Tucker council adopts ordinance authorizing bail-bond agents to post bonds in municipal court

The Tucker Mayor and City Council adopted Ordinance O2025-04-08 on second reading on May 12, amending Chapter 26 (Municipal Court) to authorize bail-bond agents to provide bonds for persons appearing in municipal court. The council voted seven to zero to approve the ordinance on the second reading.
The city attorney told the council the ordinance mirrors provisions common in other municipal courts in the metro area and noted recent state-level litigation: “the American Civil Liberties Union filed suit against the state of Georgia, alleging that Senate Bill 63 forces those who have not yet been convicted, and who are charged with misdemeanor offenses to unduly sit in jail until a cash bond can be posted.” He said the litigation could affect how pretrial detention and bond procedures operate but that municipal court staff are conducting expanded hearings — often via Zoom — to protect defendants’ rights.
The ordinance includes language clarifying that the court’s powers to honor bonds issued under the authority of the sheriff or another court or to exercise inherent powers under the city charter or state law are not abridged by the new provision.
The council approved the measure without recorded roll-call names in the public transcript; the mayor counted seven in favor.
