Board agrees to schedule public hearing on swapping industrial-park lots after title anomaly discovered

The Orange County Board of Supervisors agreed to schedule a public hearing to consider swapping county-owned Lot 14 in the Lee Industrial Park with a different lot so the Economic Development Authority can proceed with a loan and development.
County staff explained that some years ago the county retained Lot 14 while other parcels were deeded to the EDA; staff are uncertain whether Lot 14 was retained to administer a road grant or to preserve enforcement authority for covenants. The EDA now wishes to develop Lots 14 and 15 to make them pad-ready for business; the authority found a loan through the Virginia small business development loan pool, but title work showed Lot 14 remains in county ownership, blocking the closing.
Staff said swapping Lot 14 with the lot that contains the disc-golf course (believed to be Lot 5) would place the two parcels to be developed into the EDA's ownership so the loan can close and loan proceeds can pay the contractor. In the interim the county has been making the payments on behalf of the EDA, staff said.
Because county property disposal other than a lease to a public entity requires a public hearing, staff asked the board for consensus to schedule that hearing; supervisors agreed to schedule the public hearing. No formal disposition was decided at the meeting — the public hearing will allow public comment and a subsequent formal action by the board.
County staff said they will schedule and advertise the required public hearing and return with the legal descriptions and any additional details needed for the board’s consideration.
