A Harpers Landing landowner told the Fairview Town Council on May 6 that he plans to excavate a deep amenity pond inside the subdivision swale and that he has hired a hydrologist to analyze flood impacts. Town engineering staff reviewed the submitted analysis and said it showed no rise in the floodplain and that a properly designed excavation could reduce the risk of sediment accumulation.
Town engineering staff said the swale’s normal flow velocities are well above the threshold where solids settle; staff cited the civil‑engineering rule of thumb that velocities below about 2 feet per second allow sediment to settle, while measured velocities in the channel and proposed pond area were in the upper 3 to lower 4 feet per second in the submitted model. The engineering review included LIDAR‑based contour comparisons from multiple years; staff said they saw no evidence of problematic silt accumulation between 2018 and 2024 in the affected section.
Developer and homeowner Scott Powell told the council he owns multiple lots in Harpers Landing and described the area as “barren” and suited to an amenity pond for residents. He and the HOA president, Renee Powell, said the HOA would remain responsible for long‑term maintenance and that the excavation would remove material from the swale (no fill would be placed back into the floodplain). The hydrologic analysis prepared by Michael Boyd and provided to the town modeled before‑and‑after cross sections and concluded the pond excavation would not increase floodplain elevations or reduce downstream capacity.
Council did not vote to approve construction at the May 6 meeting. Council members expressed cautious support and asked the landowner to complete detailed civil drawings and a final drainage study; staff directed the landowner to consult adjacent neighbors and the HOA and requested that the developer return to the council with formal engineering plans and any revised developer/HOA agreements. Town staff said the developer must also submit revisions to the developer’s agreement and any HOA covenants that would change maintenance responsibilities. The council’s comments indicated they did not oppose further study but would require a full technical submittal and staff sign‑off before construction could proceed.
Why this matters: the proposed excavation sits in a designed swale that was constructed as part of Harper Landing’s flood mitigation; residents on the opposite side of Sloan Creek had previously been assured the swale would not worsen flooding for their properties. The town engineer told the council that a properly designed pond — particularly one dug deeper than the current swale — would likely reduce concerns about local siltation because the excavation increases storage capacity and any sediment would settle in the deeper pond area rather than raising ground elevations.
