The King George County Planning Commission deferred action on a rezoning application (Z2024-00239) submitted by Taylor Whitaker for TRW Marine and Tackle, asking the applicant to return with specific proffer language limiting permitted C-2 uses and additional utility information.
Taylor Whitaker, the property owner and applicant, described plans for a boat dealership and service center on a 2.39-acre parcel fronting Route 301 (James Madison Parkway) near Potomac Drive. The development program presented included a 5,400-square-foot boat showroom and service area plus roughly 6,000 square feet of flexible retail or office space for a total of about 11,400 square feet; the plan provided 42 parking spaces where 35 were required.
County staff noted the site lies inside the Dahlgren Settlement Area in the comprehensive plan and said VDOT had preliminarily approved a primary entrance on James Madison Parkway; the commission heard that the King George Service Authority currently has limited water capacity in the Dahlgren area and that water availability is uncertain in the short term.
Commissioners and counsel discussed the legal effects of proffers and whether the applicant should voluntarily proffer to limit the property’s allowed C-2 uses to boat sales, service, rental and repair and to the proposed small “flex retail” center. Several commissioners said they preferred a voluntary proffer from the applicant rather than the commission adding restrictions; Whitaker said he would work with county staff to supply proffer language that limits uses to those proposed.
Commissioners also raised the practical problem that Whitaker said he has not yet secured project financing and that, if rezoned to C-2 now, the property would be commercially zoned even if the owner later sold it for a different commercial use. Some commissioners said they were comfortable rezoning to C-2 because the comp plan shows the parcel for commercial use; others preferred a narrower proffer or deferral until the applicant supplies precise language.
Whitaker elected to defer. A motion to defer the rezoning to the May planning commission meeting carried on roll call.
