The Buda City Council on Feb. 18 approved full-purpose annexation of approximately 29.116 acres on Jack C. Hayes Trail and adopted a zoning map amendment to Light Industrial to accommodate a planned facility for Nighthawk Frozen Foods.
City planning staff said the property lies in Buda’s extraterritorial jurisdiction and is subject to a 2016 development agreement under which the owner agreed to seek annexation prior to development. The city’s adopted comprehensive plan identifies the site for light-industrial uses; staff noted the property is surrounded to the south and west by city limits zoned heavy industrial or agricultural and that no residentially zoned parcels lie within 400 feet.
Angela Kennedy, planning staff, told the council the nearest residence is about 1,500 feet away and the property is not currently served by city utilities; if annexation and zoning are approved, the applicant will work with the city to extend water and wastewater service before development occurs. Kennedy said annexation does not itself obligate the city to extend utilities but that the city must ensure sufficient capacity exists when connections are requested.
The Planning and Zoning Commission recommended approval of the zoning request. After a public hearing with no speakers, council voted to adopt the annexation ordinance and to approve the zoning map amendment on first and final reading. For administrative purposes the council also adopted an ordinance updating single-member District A and District C boundaries to reflect the newly annexed areas.
Staff reminded the council that utilities and service extensions are subject to standard engineering, financing and construction arrangements; the property currently uses well and septic for onsite service. Support materials submitted to the record included a letter of support from the Buda Economic Development Corporation.
Council actions authorized annexation and zoning; the property will remain subject to platting and utility extension agreements as development plans proceed.
