Council approves accessory-dwelling permit with occupancy and parking conditions

The council voted to approve a conditional-use permit to convert an accessory structure at 219 South 16th Avenue into an accessory dwelling unit (ADU), with several conditions attached.
Planning staff said the parcel is in Ward 1 in an R-2 zone and that the accessory building would be rehabilitated as living space while the primary structure is also being renovated. Staff recommended approval with conditions requiring family occupancy (a related family member 55 or older or handicapped), annual re-certification of the occupant’s qualification, a driveway of asphalt or concrete, a 20% tree canopy requirement and foundation plantings.
Planning commission supported staff’s recommendation and added two conditions: (6) the ADU must remain unoccupied until issuance of a certificate of occupancy, and (7) the family member must occupy the ADU and may not sublet to unqualified persons. Councilor Joyner moved approval and Councilor Day seconded; a roll-call vote passed with the motion carrying.
The council’s action authorizes the owner to complete the rehabilitated accessory structure consistent with the approved elevations and the additional conditions meant to protect neighborhood character and ensure required parking and occupancy rules are enforced.
