The City Commission approved a variance permitting a two-lot subdivision to be recorded without frontage on a public street, allowing access to the lots via a private drive and canal crossing.
Planning staff explained the property lies on the south side of Tobada (Tovada) Road west of FM 507 and includes an existing single-family home; the applicant proposed subdividing to allow a family member to build a second house. The private crossing and driveway that provide access to the site will remain private and paid for by property owners.
The city engineer and county marshal reviewed the request and reported no objections. Planning staff recommended approval; the Planning & Zoning Commission also recommended approval. Commissioners moved and seconded the variance and the motion carried.
The variance approval allows the two new lots to be created provided the private access remains in place and the developer/property owners comply with any required engineering or safety requirements identified by city staff. The property owner will remain responsible for maintenance of the private access.
