Staff said the request arose because the homeowner’s septic system was failing and the dwelling is a small primary residence of about 400 square feet.
City staff explained the partial waiver is a hardship exception and emphasized the city’s preference to connect failing septic systems to municipal wastewater for protection of health, safety and welfare. Staff told the council the request is not a blanket policy change but a singular hardship case recorded in the meeting backup.
Councilmember Wade Ashley moved to approve Resolution 2025‑R‑028 “as presented” and Michael Helping seconded; the resolution was included in the consent approvals as corrected to reflect a $55,000 limit noted in the packet corrections. The property owner, Mr. Cuero, did not attend the hearing.
The council and staff noted they do not commonly grant such waivers and that the action reduces the required impact fee from one full LUE to one half‑LUE for this parcel only. The council recorded the motion and proceeded with consent agenda approval.
