Genesis declines public updates as commission, city and bondholders seek mediated settlement for Charles Pointe TIF dispute

The Harrison County Commission reviewed a letter from James R. Christie, attorney for Genesis Partners, stating Genesis would not attend the meeting or make public comments because of two pending lawsuits: a federal complaint in the Northern District of West Virginia and a state case in Kanawha County.
County officials and counsel discussed efforts to resolve disputes tied to extension of the Charles Pointe TIF district and related bond restructuring. Commissioners said the developer, the city of Bridgeport and bondholders have not yet reached an agreement. Staff reported that Genesis had informed the county it would not provide public updates because of pending litigation and that Genesis expects the state will prevail in defending the TIF statute.
Commissioners and legal counsel reviewed prior negotiations, a previously proposed developer offer that was reportedly declined, and whether a mediator could help bridge differences over a proposed 50/50 split for a final 15-year period and responsibility for legal fees. Several speakers urged renewed negotiation rather than prolonged court battles; others said the developer's and bondholder's consent is required because restructuring would affect bondholder rights and developer interests.
County counsel said the bondholder's attorney might be willing to facilitate talks among the county, the city and Genesis Partners. The commission asked staff to pursue such outreach and to report back; no formal settlement was approved at the meeting.
The exchange is part of a broader agenda of matters tied to TIF extensions, trustee replacement and possible litigation the commission authorized earlier in the session.
