Town of Stratford planning staff told the Board of Appeals that changes in the town’s new zoning regulations mean swimming pools are now included in lot coverage and impervious‑surface calculations, which has increased the number of variance requests. To reduce cost burdens for homeowners seeking above‑ground pools, the board voted to permit a scaled, stamped site plan in lieu of an expensive A‑2 survey for above‑ground pool permit applications, while retaining the A‑2 requirement for in‑ground pools.
Planning staff said under the prior regulations pools had been excluded from lot coverage calculations; the current regulations include pools in lot coverage and impervious-area totals. The change has resulted in several applicants being told they must apply for a variance because their proposed pool would cause lot‑coverage exceedances. Staff reported that an A‑2 survey can cost more than the pool itself for many applicants and can delay permit issuance because of survey turnaround time.
During discussion board members and staff agreed that above‑ground pools are often removable and less permanent than in‑ground pools, and that requiring an A‑2 survey in every case would be an excessive barrier. The board’s direction was to allow applicants for above‑ground pools to submit a scaled site plan prepared by a draftsman, architect or similar professional showing proposed coverage and a zoning table; the board retained the A‑2 survey requirement for in‑ground pools.
The board made the recommendation by motion and voice vote; the record shows the board voted unanimously to waive the A‑2 survey requirement for above‑ground pools in favor of a scaled stamped site plan. Staff was directed to draft specific language and bring text back to the board for formal adoption or administrative guidance so the planning office can accept the revised submittal format on a transitional basis.
