Applications and locations: Sugar High (proposed at 112 Washington Ave., the old Rainbow Cleaners building) includes interior-only renovations and currently has commercial uses and upper-level apartments; Elevate (location discussed separately) is in a commercial building with no residential units above.
Council concerns and proposed conditions: Committee members and members of the public raised concerns about impacts to neighbors, odor control, parking in the downtown Washington Avenue corridor, and the presence of residential units above a retail cannabis store. Committee discussion produced a set of conditions to forward with the IUP: (1) a limited initial IUP term (committee agreed on a two‑year interim term, renewable), (2) annual staff review with results reported to council, (3) no on‑site product sampling, (4) hours of operation limited to 10 a.m.–8 p.m., and (5) for locations with apartments above the retail space, building ventilation/odor mitigation measures to protect residents (language to be specified by staff). Sugar High’s owner, Emily McCune, addressed the committee and said she is amenable to many conditions but opposed a condition that would bar residential units above the business because state rules do not prohibit residential above a retail cannabis business and such a condition would materially affect the operator’s ability to proceed.
Action and votes: After extended discussion and several proposed motions, the committee approved a motion to forward Sugar High’s IUP application to the full council subject to the conditions above (two‑year interim permit, annual staff review, no sampling, hours 10 a.m.–8 p.m., ventilation measures for shared buildings). The committee separately approved forwarding Elevate’s IUP (with the same package of conditions except the residential‑ventilation clause because that building has no residential units above). Both items will appear on the council agenda for final action.
Next steps: Staff will prepare exact condition language and any necessary follow-up materials (for example, clarification from legal staff on sampling vs. sampling rules in state guidance) for the Monday meeting. Planning and police enforcement issues raised (parking, loitering, public consumption) were flagged for further coordination with public safety and public works.
