Commissioners approve two section-line vacations affecting Kennys and Williams parcels

The Lawrence County Board of Commissioners approved two related petitions to vacate plat elements and a section-line right-of-way affecting property owned by Jeff and Chris Kenny and Jeremy and Tanya Williams.
Brandy Divert, speaking for a property owner, told the board the affected properties have alternative access and that the section line is rough terrain that does not provide practical vehicular access. "If you try to drive the section line, you'll go as you go to the east. It's very, very rough, so you can't get through there anyway," she said during the public hearing.
County staff explained the two petitions were closely related: one (Resolution 2025-18) would vacate part of a plat (the utility easement), and the other (Resolution 2025-19) would vacate the section-line right-of-way. Commissioners discussed access to public lands and whether the Bureau of Land Management or other public roads provide sufficient access. County counsel recommended including the statutory phrase that the vacation "does not abridge or destroy any of the rights and privileges of other proprietors in such plat" when making the motion.
The board moved and seconded to approve resolution 2025-18 (vacation of a portion of the plat) with the statutory language added; the motion passed on a recorded voice vote. The board later approved resolution 2025-19 (vacation of a portion of Section Line Highway), again including the statutory language.
Ending: Staff will record the resolutions and apply the amended plat/right-of-way status to county records; petitioners and neighbors present said the vacation should resolve setbacks and clarify property use and access for the parcels involved.
