Council approves amended and restated BCRUA master contract and updated bylaws

The Round Rock City Council approved an amended and restated master contract for the Brushy Creek Regional Utility Authority (BCRUA) and separately adopted updated bylaws that reorganize governance and administrative procedures.

City staff said the original BCRUA master contract dates to February 2008 and had been amended seven times. The amended and restated document consolidates all prior amendments and exhibits into a single, clarified contract that describes capacity ownership and phases for each participating city — Round Rock, Leander and Cedar Park — and makes it easier for the partners and the public to see who owns what capacity in each phase.

Council also approved amended bylaws for BCRUA. Staff highlighted several changes: the two board members from each city will serve synchronized two‑year terms that start and end together; an operating committee of staff from the three cities will continue handling daily operations and capital planning; the bylaws specify appointment of a general counsel (identified in the meeting as Steve Sheets); and the board may approve items up to $500,000 without seeking separate city approvals if those items are budgeted.

The BCRUA board approved the amended and restated master contract and the bylaws at a recent meeting, and staff recommended that each partner city take action to adopt the documents so they are consolidated into single, consistent governance materials.

Motion to adopt the master contract resolution and bylaws was made by Council Member Flores and seconded by Council Member Ortega; all members present voted yes. City staff said the bylaws will be posted on the BCRUA website and linked from each partner city’s site for public access.
