County and Kingbird Solar LLC agree to terminate development, road-use and decommissioning agreements

Kingbird Solar LLC told the Bourbon County Commission it will terminate three agreements with the countythe development agreement, the road-use and maintenance agreement (RUMA), and a decommissioning agreementand start over to re-engage the county under the newly seated commission.

A company representative, speaking for Advanced Power (the company representing the project), said the termination is intended to "start fresh and work with the new commission, in whatever capacity that takes." The representative asked the county to facilitate signing the termination forms so the company can reinitiate public meetings and accept input from county officials and the public.

After brief discussion about titles and references in the paperwork, the commission voted to sign three termination documents: termination of the development agreement, termination of the road use and maintenance agreement, and termination of the decommissioning agreement. A motion to approve the terminations was made and seconded; commissioners instructed project representatives to arrange future public-interest meetings with the commission and to contact the county's designated point person for further coordination.

Commissioners also noted that landowner and private agreements with project landowners remain separate from these county agreements and urged the company to continue communication with landowners and the public as it revises plans.

The commission recorded that it will resume engagement if Kingbird Solar returns with revised project plans and community meetings.
