The Waxahachie City Council denied with prejudice a specific use permit (ZDC 220/2024) for a short‑term rental at 807 Doctor Martin Luther King Jr. Boulevard, saying the applicant had continued to rent the property while the required application and documentation were incomplete.
Planning & Zoning had recommended denial 5–0. During the public hearing the applicant, who identified himself as the property owner, said he had listed the property for sale in 2023 and later used it as interim rental property; he acknowledged that staff had asked for additional documentation and application fees. Council members and staff said the property had been rented after the application process began and that hotel/motel tax collection, a local emergency contact within the city’s required distance, and other documentation had not been completed.
Council moved to deny with prejudice, which the city attorney explained prevents reapplication for six months. Council members told the owner to stop operating the rental until he complied, to remit any due hotel/motel taxes for prior renters and to resubmit a complete application if he wishes to apply after the six‑month period.
The motion to deny with prejudice carried unanimously. Planning staff will follow up on code‑compliance and tax collection as part of enforcement and any future application review.
