Board approves hearing officer recommendations to restore Val Vista alignment and drainage dedications in Sunset Canyon PAD amendment

The Pinal County Board of Supervisors on March 5 voted 3-2 to approve a hearing officer’s recommendations that restore an earlier alignment of Val Vista Road and revert regional drainage dedications for the Sunset Canyon planned area development (PAD). The board’s action follows a December 2024 PAD amendment and a subsequent administrative appeal under state law.
The hearing officer’s recommendations remove a previously required north–south, 150-foot-wide parkway (shown in the December 2024 visual plan) that bifurcated the property and restore Val Vista Road to its prior, northern alignment. County staff told the board the change also deletes a drainage dedication that had been added in the December 2024 approval and returns drainage to the 2003 configuration; any drainage dedications required at the later planning stage will be negotiated then.
Why it matters: The change addresses an administrative appeal filed by the property owner that challenged roadway and drainage dedications imposed in December. Neighbors and speakers at the meeting raised concerns that shifting the Val Vista alignment and other conditions could affect commercial acreage, school parcel size and the character of nearby residential areas.
County staff and the hearing officer told the board the recommendation does not increase the number of housing lots or alter zoning, commercial acreage or the 14-acre school parcel that had been depicted in recent materials. Staff said the action restores the road and drainage to where they had been under the PAD approved in 2003 and that any substantive changes to commercial or school parcel sizes would need to be addressed later at the planning stage.
Board debate centered on residents’ concerns about loss of nearby commercial land and whether reverting the alignments would effectively return acreage to the developer. Supervisor comments show some supervisors favored disapproving the hearing officer recommendation to try to secure additional commercial acreage for residents; another motion to disapprove failed. A subsequent motion to approve the hearing officer recommendation passed 3-2 by voice vote.
Public comments before the vote included objections from nearby residents who said developer filings and records had been difficult to access, questioned sequencing of parcel approvals and asked why grading and heavy equipment had been active when some parcels had not appeared on prior agendas. Planning staff responded that the development is large and is not being constructed in parcel order; staff also said they would follow up on a resident’s public-records concerns and on why some records had been redacted for review by the county attorney’s office.
Procedure and next steps: Under Arizona Revised Statutes permitting administrative appeals of dedications, the hearing officer’s recommendation goes to the board for final action; the board may approve, deny or continue the matter. The county attorney’s office, and planning staff, said the board could also continue the item or the property owner may pursue judicial review after the administrative process.
What the action does not do: County staff emphasized multiple times that the board’s vote only addressed the two challenged dedications (Val Vista alignment and the drainage dedication). The vote did not change zoning classifications, the approved housing density or restore additional commercial acreage beyond what was previously approved in December 2024. Staff said any adjustment to school acreage or commercial acreage would have to be handled at the later planning and platting stages if necessary.
Board outcome: The motion to approve the hearing officer’s recommendations passed by a 3-2 vote. The board recessed into executive session during the item before returning for the final vote.
