Planning staff explained the partition filing: a personal representative filed a motion to partition estate property, producing a five-acre parcel (to be conveyed to Linda Fay Lewis) while leaving the remaining acreage in the estate. Staff told commissioners the proposed shift would move the parcel 15 feet west to correct a gap on the western border and that the parcel would remain five acres. The planning department had prepared a formal comment letter and presented it to the board.
Commissioners and staff discussed adding text to the letter advising the court that additional divisions may be forthcoming and that it would be more efficient for the county if subsequent court-ordered divisions were considered together. Planning staff confirmed the county had not received full information about all heirs or future divisions and recommended adding a statement to that effect in the comment letter. The board moved, seconded and voted to approve the comment letter as amended. The planning presentation referenced sections of state law and the Montana Subdivision and Plat Act and attached the proposed certificate of survey to the record.
