Carrollton City Council approved a request on April 15 to waive the 12-month waiting period that accompanies a denial of a zoning special-use permit, allowing the applicant associated with 2925 Rolling Hills Drive to reapply sooner than the ordinance’s standard waiting period.
City staff clarified that the item was not a debate on whether a short-term rental is appropriate at the property but strictly a decision on whether to waive the statutory 12-month waiting period that typically follows a denial with prejudice. “This would not be a discussion… whether or not an STR is an appropriate use there. It's whether or not you're willing to allow them to waive the 12 month waiting period,” staff said.
Councilmember Nancy Palacios moved to approve the waiver and Councilmember Carpenter seconded. The motion passed with two councilmembers recorded in opposition: Councilmember Axberg and Councilmember Klein.
The waiver restores the applicant’s ability to submit a new special-use permit application within 12 months rather than being barred for a year after the earlier denial. City staff emphasized that approving the waiver does not approve the short-term rental itself; the applicant must still proceed through the zoning process and hearings.
Ending: The council’s action removes the timing barrier and allows a new application to be filed within the zoning process timeframe. Any subsequent application will follow normal public-notice and hearing procedures under the city’s zoning ordinance.
