Council authorizes hiring retired fire chief as interim while recruitment proceeds

Staff explained that Government Code section 7522.56 requires a 180-day separation before a CalPERS retiree may be rehired by an employer in the same retirement system unless the governing body adopts a resolution to waive that waiting period for critical services and completes certain notices and certifications. Council voted to authorize the retired-annuitant appointment, approve the employment agreement and direct staff to provide necessary certifications to CalPERS.
City staff said the interim appointment offers continuity of command and is likely to be less expensive than engaging an external interim contractor. The agreement includes an hourly cap (960 hours per fiscal year) consistent with annuitant limits; staff said the city will continue a national recruitment for a permanent fire chief and that the annuitant’s assignment will end if a permanent candidate is hired before the cap is reached.
Ending: The motion passed unanimously and staff will file the required CalPERS certifications and post the recruitment; the city will proceed with a consultant-led recruitment for a permanent fire chief.
