Millcreek planning commission recommends broad rewrite of zoning and subdivision code

Millcreek — The Millcreek City Planning Commission voted to recommend adoption of a broad recodification of the city27s zoning and subdivision code, endorsing new and revised chapters covering general provisions, review bodies and procedures; subdivisions; development and use standards; definitions; and related topics including nonconformities, accessory dwelling units and floodplain/hazard language.
The revisions consolidate existing rules, update cross-references and add new procedures intended to ensure compliance with state statute and federal floodplain requirements. Staff said the first four chapters serve as the code27s enabling language and clarify the relationship between the zoning code and the general plan and transportation master plan.
Commission staff presented the draft chapter-by-chapter and provided a model motion for each section. Planning staff said many pages contain only technical or minor edits but that some new material addresses residential facilities for persons with disabilities, eligible facility requests for wireless facilities, and a single consolidated chapter of definitions.
Commissioners moved through separate motions recommending adoption of the general provisions chapter, the subdivisions chapter, the zones-and-districts chapters, and the development and use standards and definitions. The commission also recommended repeal of the Foothills and Canyons Overlay (FCOS) and its replacement by a sensitive-lands chapter that applies standards where physical site conditions (steep slope, alluvial fans, liquefaction risk) warrant them rather than by map only.
Several community councils and staff briefs were cited during the meeting: Millcreek Community Council, Mount Olympus Community Council and Canyon Rim Citizens Association each provided written recommendations and were recorded in the staff report. Commissioners pressed staff on a small number of policy choices but otherwise voted to forward the revised code to the next step with the clarifications and study topics they requested.
Ending: The recommendations will be forwarded to the city council as the Planning Commission27s formal advice. Staff will return redlines and proposed code language addressing the clarifications requested by the commission before the city council27s final public hearing.
