Commission authorizes Attorney General's office to assist in State v. Nathan Smith

The Gallatin County Commission on April 22 approved a resolution authorizing the Montana Attorney General’s Office to provide prosecutorial assistance in the criminal matter State v. Nathan Smith.
Lee Ann Certain, deputy county attorney, told the commission the resolution would permit the Attorney General’s Prosecution Services Bureau to provide assistance and that one of the AG’s attorneys — identified in discussion as Michael (M.) Kitzmiller, who began the prosecution while with the county attorney’s office — is expected to second-chair the trial. Certain said the assistance is provided without an additional charge from the Attorney General’s Office for its services; however, ordinary costs such as witness fees remain the county’s responsibility.
Staff and commissioners had no additional comment, and the commission adopted resolution number 2025-033 by voice vote.
