City conditionally approves Highbore Acres site condominium phase 1 with stormwater maintenance by HOA

Staff and the applicant told the commission the current submittal shifts the development to a site condominium under the Condominium Act so private yard drains and stormwater maintenance can be managed by a homeowners association rather than by the city.
Why it matters: The change affects long-term maintenance responsibilities for stormwater features and lot lines adjacent to a detention pond. Staff said that under site condominium governance, the homeowners association would take maintenance responsibility for private yard drains and associated infrastructure previously called out in preliminary plat conditions.
Details: The proposal covers 43 lots on about 17 acres; roads will remain public. Planning staff recommended conditional approval with five conditions. The applicant’s engineer, Rob Lamer of XO Engineering, was present to answer technical questions and said the only changes from the approved plat concern stormwater maintenance and condo governance.
Vote and next steps: The public hearing closed with no public comments. Commissioners approved the site condominium with a voice vote. Staff will ensure the required declaration of covenants, easements and restrictions includes language that easements and access cannot be changed without city approval.
