Planning board grants 90-day extension for Parkview Terrace minor subdivision

The Summit Planning Board voted unanimously on Feb. 24 to grant a 90-day extension to record the Parkview Terrace minor-subdivision deed, extending the filing period to April 28, 2025.
Hillary Alls of Dempsey & Sheehan, representing applicants Michael and Susan Vallow, told the board that the required storm-sewer agreement had been signed by the mayor and that the subdivision deed was to be signed by the board chair; the documents have not yet been returned to the applicant for recording. Alls said the outstanding items are administrative and that the applicants have submitted the deed for review.
Board counsel noted the Municipal Land Use Law authorizes extensions to the statutory filing period when applicants can show they were prevented from recording the deed despite reasonable diligence. The board adopted a resolution to grant the requested 90-day extension and approved it by roll call with nine votes in favor and no opposition.
Chairman Steven Spur said board members who did not vote on the original application are nonetheless entitled to vote on an extension request. The board's action will allow the applicants additional time to perfect the subdivision recordation.
