Concord Township approves conditional use for outdoor dining at Heroes Bar and Grill with limits on hours, seating and entertainment

Concord Township Council on May 13 approved a conditional-use permit allowing seasonal outdoor dining for Hero's Bar and Grill at 996 Baltimore Pike, subject to detailed conditions limiting hours, the number of tables and prohibiting live entertainment.

The resolution, read into the record as Resolution No. 28 of 2025, said the outdoor dining area must “be confined to the area delineated on the McFadden architect plan TCA memorandum dated 04/15/2025, last revised 05/07/2025,” and that the applicant must follow the referenced TCA memorandum.

Conditions in the decision limit outdoor seating to a maximum of 10 tables and 40 seats, allow alcohol service only to patrons seated at tables, prohibit live music or entertainment in the outdoor area, require the area to be enclosed by a fence with at least two gated emergency egress points and handicap ramps, and require an on-duty hostess during outdoor hours. The permit allows outdoor dining seasonally from April 1 through Nov. 1, 8 a.m.–10 p.m. Sunday–Thursday and 8 a.m.–midnight on Fridays and Saturdays.

The applicant is Robert Keats and 368 Bar Inc., identified in the application as the restaurant owner. The resolution states that “approval for outdoor dining is limited to the applicant and will cease upon termination of the applicant's tenancy.” The council also required several safety and accessibility repairs to the patio and landscaping in accordance with TCA recommendations.

Council discussion included a nonbinding suggestion that the building exterior’s rear or sides be repainted to match the front; the record notes that suggestion was not made a condition of approval. The resolution passed; the council took no subsequent action at the meeting related to the permit.
