Senate approves bill expanding law against nonconsensual intimate images to cover AI "deepfakes"

The Oregon Senate passed House Bill 22 99, which updates state law on the nonconsensual dissemination of intimate images to include artificial-intelligence–generated “deepfakes,” sponsors said on the floor.
Senator Kim Solman carried the measure and told colleagues that Oregon criminalized nonconsensual dissemination of intimate images in 2015 but that technology has advanced. “Artificial intelligence can generate hyper realistic, intimate images without a victim ever posing or consenting,” she said on the floor, urging colleagues that the bill will “close this dangerous loophole” and protect minors and adults.
Solman cited data she said were provided to the chamber: an 857% increase in related tips to the Oregon Department of Justice Internet Crimes Against Children Task Force in the last four years, from about 200 tips in 2020 to almost 2,000 last year; she also cited that “99% of those victimized by intimate deepfakes are women and girls” and that “31 states have already passed legislation regulating the circulation of intimate deepfakes.” These figures were presented on the floor as part of the bill’s justification.
The bill passed on third reading; the clerk recorded a roll call with the final count recorded as 30 ayes. The bill’s floor explanation emphasized protections for victims, including minors, and modernization of enforcement tools for law enforcement.
