The Hendry County Commission continued debate May 13 on proposed changes to the Land Development Code (LDC 25‑0001) to allow shipping containers as accessory storage structures under specified acreage and location rules.
Ryan Alexander, director of planning and community development, said staff had presented two options previously that differed by parcel acreage thresholds: one approach would allow 40‑foot shipping containers on parcels larger than 1 acre (with limitations tied to acreage for multiple containers), and another option would allow smaller containers on smaller lots. Alexander asked for time to provide parcel maps and overlay details. Commissioners expressed mixed views: some said shipping containers could be an affordable, durable replacement for deteriorating sheds in rural areas; others noted homeowner‑association restrictions, neighborhood character concerns and existing code‑enforcement cases involving containers.
Commissioner comments emphasized the need to exclude sensitive neighborhoods. One commissioner noted staff found 16 active code cases related to shipping containers and asked staff to factor enforcement capacity into any change. Commissioners discussed carving out areas such as Banyan Village and Port LaBelle (already mentioned by staff) and possibly adding other exclusions based on overlay maps. The board voted to continue the item to the next meeting so staff can present maps showing where the change would apply and where exemptions would be appropriate.
Why this matters: Revising the LDC to allow shipping containers would change permitted uses of private property across parts of the county, with tradeoffs between property‑rights arguments, neighbor impacts, aesthetics and code‑enforcement workload. Staff will return with maps and recommended overlay exclusions for further board action.
