Flathead County commissioners adopted Resolution No. 1049S on May 13, approving text amendments to the Canyon-area land-use regulations that revise short-term rental and guest-cottage standards and add a definition for duplexes.
Planning Director Eric Mack said the amendments add duplexes to the definition of eligible structures for short-term rentals where allowed, and the county inserted a duplex definition consistent with zoning language. The amendments permit up to two short-term rental units in a duplex within a designated community center, and retain a minor land-use review process for guest cottages and accessory units.
The text changes also add operational standards for short-term rentals, including required fire-safety brochures and bear-proof containers, and allow waivers and exemptions consistent with recently passed state law for childcare and schools. Commissioners amended one provision during debate to require one off-street parking space rather than two for single short-term rental units in certain subsections; the board approved the amendment and then adopted the resolution as amended.
Why it matters: The changes aim to clarify where short-term rentals and guest cottages are allowed, provide public-safety measures for short-term occupants, and align county rules with recent state changes on waivers. Planning staff said the standards are intended to accommodate tourists while protecting community character and public safety.
Next steps: The resolution as adopted modifies county land-use rules; implementation will be through the county’s minor and major land-use review processes. Planning staff did not announce an effective date at the meeting; the board’s action will be reflected in the county code update process.
