The Fairview Planning Commission voted to recommend approval of an annexation request for three contiguous parcels totaling 53.162 acres on Oldcox Pike, a staff member said. The parcels are identified as tax map 43, parcels 15, 52 and 53; the property owner is Marlon Cunningham.
The recommendation will place the annexation on the Fairview Board of Commissioners agenda on Thursday, June 5, with a potential public hearing and second reading on Thursday, July 1, staff said. Commissioners and staff emphasized the commission was acting on annexation only; any rezoning request would come separately.
Ethan Greer, planning staff, read the application and explained how the parcels sit inside the city's urban growth boundary and are contiguous to Fairview municipal limits because of the Pinecrest subdivision to the east. Greer said the properties are currently in Williamson County zoning districts MGA-5 and MGA-1 and are classified under the Fairview Forward 2040 plan as either "new residential medium neighborhood" or "rural settlement," depending on the parcel. "The property owner has indicated and requested these 3 properties to be rezoned to R 20," Greer said.
Joe Epps, representing owner Marlon Cunningham, told the commission he had no additions to the staff report. "No. I think that was an excellent staff report," Epps said.
Commissioners asked for clarification about the timing for rezoning. Greer explained that the rezoning application will come to the planning commission in June and, if recommended, would proceed to the Board of Commissioners for readings in July and August; if annexation fails at the Board of Commissioners, the rezoning would be moot.
The motion to approve the annexation recommendation was made and seconded during the meeting and carried. Votes recorded during the planning commission roll call were: Mayor Anderson, Aye; Miss Schilling, Aye; Mister King, Aye; Mister Magner, Aye; Miss Schulist (recorded as "Miss Shoeless" in the transcript), Aye; Mister Kelly, Nay; Mister Pate, Aye; Vice Mayor McDonald, Aye.
What happens next: if the Board of Commissioners approves annexation on first reading, the rezoning application would continue through the typical two-reading process; if the board rejects annexation on first or second reading, the rezoning request would not proceed.
The commission's action tonight was limited to recommending annexation; the commission will take no formal zoning action on these parcels at this meeting.
