Commissioners approve Lawson boundary relocation exemption to place well on associated parcel

Broadwater County commissioners approved a boundary-relocation exemption requested by David and Jamie Lawson to amend two adjacent lots in the Sand Hill Heights subdivision so that an existing well that serves one residence will be located on the parcel associated with that residence.
Nicole Brown, community development director and planner, presented the staff report and explained the proposal relocates common lot lines between Lot 13A and Lot 13B (the Lawson-owned lots) within Section 35, Township 7 North, Range 2 East. Brown told commissioners that, under Montana Code Annotated 76-3-207(1)(d), boundary relocations of five or fewer lots are allowed within a platted subdivision and that the parcels remain subject to DEQ review because both parcels will be under 20 acres.
Brown said the applicants already had Department of Environmental Quality review and email confirmation in the staff packet that the DEQ had reviewed and issued a revised certificate of survey reflecting the boundary change and well location.
Brown read the findings of fact and recommended approval. A commissioner moved to approve the Lawson boundary-relocation exemption; after public comment was called and none offered, commissioners voted by voice and approved the request. Brown noted that no structures will be transferred; the proposal only adjusts lot lines to place the well on the parcel which uses it.
