The Whitestown Town Council approved an agreed findings and judgment on May 14 to resolve an eminent-domain dispute connected to the Petersen–Hall Street realignment project, authorizing a payment of $415,000 to resolve the matter.
Town staff explained the project requires acquisition of a garage parcel that is platted separately from an adjacent residence; removing the garage would affect access to the home, so staff and the property owner negotiated a settlement that covers the parcel the project needs and resolves relocation and damage claims. Staff said the town completed appraisals and negotiations and that the $415,000 figure balances settlement costs against additional legal expenses that litigation would have incurred.
Staff said the town will own the acquired parcel and intends to put the residential parcel back on the market through the Redevelopment Commission or similar mechanism to recoup funds; that plan mirrors prior disposition steps the town used on an acquired property on Main Street. Council approved the agreed judgment by roll call, 5-0.
Staff noted a few administrative corrections will be made to the judgment form (mailing addresses listed in the document used the wrong city name). Team members said two additional parcels remain in eminent-domain processing for the same realignment project and that the town expects to complete those steps without going to jury trial on valuation.
