Boulder County commissioners heard a call‑up on April 15 over a proposed conversion of a carport to a detached garage at 2566 Crestridge Court but were unable to reach a majority decision; per county procedure, the planning director’s determination remains in effect.
Community Planning and Permitting planner Jesse Lammers outlined the application and staff analysis. The project proposed converting a previously permitted carport into a 286‑square‑foot enclosed garage; staff calculated a resulting total residential floor area of 4,459 square feet after including a permitted 2024 garage addition, exceeding the neighborhood’s presumptive size maximum (PSM) of 4,182 square feet by 277 square feet.
Lammers told the board staff considered an allowance in the code that permits existing subterranean floor area to be excluded from the PSM calculation. He said “CPMP staff is recommending that the board uphold the director's determination of SPR 24‑0098 … as approved” subject to conditions in the January 30 determination letter with an updated square‑footage total.
Neighbors raised a lighting concern at the meeting; one neighbor said a fixture “still shines directly into our First Floor” and asked how lighting for the new garage would be handled. Lammers said no lighting plan had been submitted and a lighting plan would be required with the building permit if fixtures were proposed.
During deliberations commissioners discussed whether part of the basement qualified as subterranean under the land‑use code. They did not achieve a majority vote to overturn or to table the call‑up; county counsel advised that no board action would leave the director’s determination in place. The hearing record will note the director’s determination remains the operative decision until and unless the board takes a majority action at a later date.
