County counsel reported the Orange County Board of Supervisors met in closed session under Government Code section 54956.9(d)(1) and "unanimously approved a proposed $100,000 settlement in the matter of Yvette Agrilar versus the County of Orange," a spokesperson said.
The case stems from a motor-vehicle collision on the 55 Freeway in which an OC Animal Care vehicle struck the plaintiff's Volvo, causing "personal injuries and property damage," county counsel said.
County counsel told the board the settlement "remains subject to the final approval of others" and that, once finalized, copies of the agreement "will be made available through the office of CEO Risk Management to any person who inquires." Aside from that item, county counsel said the board "took no other reportable action" in closed session.
The announcement referenced Government Code section 54956.9(d)(1), the provision that allows a legislative body to hold a closed session to discuss pending litigation. The board said one scheduled closed-session item (labeled CS 1 in the agenda) was deleted and SCS 2—the Agrilar matter—was considered.
The report did not name the individuals who approved the settlement, give a final payment date, or identify the "others" whose approval is required. The county counsel's statement, as read into the record, is the only formal account provided at the meeting.
Copies of the final settlement agreement, the county counsel said, will be available through CEO Risk Management after any remaining approvals are completed.
