Using historical contract data, she proposed raising the dollar threshold from $25,000 to $200,000 to exempt smaller contracts and avoid disadvantaging small local shops; staff countered that most comparable RBOs in Illinois use $20,000–$25,000 thresholds.
Liza Robertson, chief legislative policy advisor, clarified that item 5 of the draft ordinance adds a waiver process that would permit council, by vote, “to waive any provision of the RBO” and that the packet contained background showing most enacted RBOs set thresholds at $20,000–$25,000. Jeremy Esparza (staff) recommended a broad waiver because implementing separate exemptions (for apprenticeship, self‑performance, etc.) would require staff to verify detailed personnel qualifications for bidders and could overwhelm staff workload; he said, “I would recommend a waiver across the board.”
The committee agreed on three explicit changes before forwarding the ordinance: (1) add a waiver process limited to local businesses, (2) change the waiver vote threshold from two‑thirds to a simple majority, and (3) remove the PLA requirement after staff advised there had been recent Third Circuit litigation raising First Amendment concerns. The committee adopted those amendments and voted 4-0 to move the ordinance forward.
Speakers emphasized balancing support for local businesses with ensuring constructor experience and apprenticeship opportunities. The final ordinance language and related redlines will appear in the council packet; the committee’s action was to amend the draft as described and forward it to council for final action.
