Commission discusses clarifying retail sale of controlled substances from licensed medical uses

Louisa County planning staff asked the commission to approve edits clarifying the county's zoning distinction between licensed medical facilities that may handle controlled substances and businesses that retail controlled substances without medical oversight.
At the May work session, staff explained the draft change would allow for inpatient and outpatient care uses to be differentiated from retail sale of controlled substances "which would be in a business that essentially sold controlled substance with no DEA license or medical professional," staff said. The intent, staff said, is to permit medical facilities run by licensed physicians or those with a DEA license while preventing unlicensed retail sales.
Commissioners asked whether in‑home care that participates in Medicare and is provided by family members would fall under the zoning change. Staff responded that purely in‑home family caregiving would not be a zoning use that requires a permit; the draft change would address facilities that are an organized base of operations rather than informal in‑home care.
No vote was taken; staff said they would incorporate the commission's clarifications into the ordinance language for future review.
