Plan Commission approves Painted Hills lot vacate and replat to allow detached garage

The Morgan County Plan Commission on May 12 approved petition RP 25-03 to vacate three lots in the Painted Hills subdivision and replat them as a single lot at 4078 E. East Rembrandt Drive in Jackson Township.
Daniel Bowling, representing the property owners, told the commission the change is being sought so the owner can build a detached garage that his homeowners association requires be on the same lot as the residence. "We're just trying to, build a garage, at this residence, and our HOA rules, won't let us build a structure if it's not adjoined to, like, the house," Bowling said.
No members of the public registered opposition during the hearing. After the public portion closed, a motion to approve the petition was made and seconded; commissioners voted in favor and the motion carried.
The replat consolidates multiple lots under a single parcel so structures counted by the HOA will sit on the same legal lot. The commission did not record additional conditions on the approval at the meeting.
The commission moved immediately to its next agenda item following the vote. No appeals, variances, or related legal authorities were referenced on the record during the public hearing.
