Council approves conditional use permit for one-chair beauty shop at 9 Water Oak Drive with conditions

Conway City Council on May 13 approved a conditional use permit to allow a home-occupation beauty shop at 9 Water Oak Drive, with conditions that limit hours, space used and signage and that restrict nonfamily employees.

City staff explained that home occupations in R-1 require conditional-use approval and listed conditions placed on the permit: hours limited to 9 a.m.–6 p.m. Monday through Friday; treatments limited to hair-salon services; the carport must be enclosed for salon use; the home occupation may occupy no more than 25 percent of the gross floor area; external evidence of the business is prohibited except for a single non-illuminated, 2-square-foot identification sign; no employees other than immediate family are permitted; equipment that produces noise, vibration, glare, odors or interference is not allowed; client parking is limited to the driveway and curb in front of the property; the permit expires if not implemented within 18 months or if the use ceases for 18 months; and the use is limited to one customer at a time.

Applicant Dana Hamilton of 9 Water Oak Drive spoke in favor of the conditions and said they do not affect her current operations; she told the council she had spoken with neighbors and they supported the proposal. A council member asked staff about compliance and enforcement; staff said they would issue a warning and revoke a conditional use permit if conditions are not met, and that revocations are rare.

A motion to approve the conditional use permit was made and seconded; the council voted in favor. The permit includes the specific enforcement path staff described.
