Bryan Planning Commission approves 5-foot relief for side-yard setback at 1126 Buffalo Road

The Bryan Planning Commission on May 5 approved a 5-foot variance from the 15-foot side-yard setback at 1126 Buffalo Road to allow a side addition to the east building of the former Easter Tire site.
The variance will permit the owner to build a side addition that, as staff explained, “gets into the 15 foot side yard setback” and for which staff recommended five feet of relief to allow the addition to fit on the lot. The motion to approve carried on a roll call vote with a majority of commissioners voting yes.
Why it matters: The approval lets the property owner reconfigure and expand the existing building to consolidate equipment and operations into a renewed structure. The commission discussed fire-safety clearances and neighbor notice before voting.
Andrew (staff member) presented the item to the commission and described the request as relief of a 15-foot side-yard setback by five feet so an addition can be attached to the east building at the former tire site. Applicant Jerry Partee described his plans and purpose: “I’m trying to prepare for my future” and said the addition would allow him to consolidate equipment and create a personal shop and storage for current businesses, including Fawn City Fitness.
Commissioners asked about Fire Department concerns and neighbor notification. Andrew said he had spoken with Chief Poole and that the chief “had no concerns,” and that neighbors within 250 feet had been notified. Commissioners discussed maneuverability and access between buildings; one commissioner noted the State Building Code’s 10-foot clearance requirement from a property line and that the proposed layout would preserve about 20 feet between buildings for fire safety.
The public offered no objection during the hearing. After a motion to approve the five-foot relief the roll call recorded a majority in favor and the commission announced the motion carried and the variance was approved.
Next steps: With the variance approved, the applicant may proceed with permitting and construction drawings subject to the city’s building permit and state code review. The commission did not attach additional conditions in the public record at the meeting.
