Putnam County authorizes settlement and mutual release in long-running Dowell lawsuit

Putnam County commissioners voted May 13 to authorize the commission president to sign a settlement agreement and mutual general release in litigation involving homeowners Joshua and Rachel Dowell and several other parties.
A staff member described the litigation history: a suit first filed in February 2021 named Putnam County, Wolf Creek, Cherry River Construction and other parties. Through mediation, parties reached an agreement that includes a full release of claims and a settlement that allocates responsibility across contractors, insurers and other involved entities. "All parties that were involved, whether it be contractors, insurance companies, everybody, is taking partial responsibility in this to get this settled and and move forward for these homeowners," a staff presenter said.
The commission approved a motion authorizing the commission president to sign the release and settlement documents on the county's behalf. The action was presented as a resolution to conclude litigation and allow the parties and homeowners to proceed with repairs and other remedies provided for under the agreement.
