The Johnson County Board of County Commissioners adopted a resolution April 24 authorizing condemnation, if necessary, to acquire rights‑of‑way and easements for the Mission Road Safety Improvement Project between Orchard Lane and 170th Terrace.
Ryan Sims of the county Public Works Department told the board staff had reached agreements with two property owners and continued negotiations with others but requested the resolution to preserve the county’s ability to proceed if negotiations fail. The motion authorizes the county to use condemnation under state law to acquire the necessary rights and to compensate owners via the court process when required.
Commissioners said staff historically uses condemnation sparingly and only after thorough negotiations; Commissioner Ashcraft and Chair Mike Kelly both praised staff diligence in pursuing negotiated agreements when possible. The motion passed unanimously (Commissioners Fast, Myers, Brewer, Hanslick, Ashcraft and Chair Mike Kelly voting aye).
