The Plan Commission opened a joint public hearing May 5 on a comprehensive plan amendment and rezoning petitions filed by Donald R. Gare III, doing business as Don’s Holdings LLC, for properties at 16200 West National Avenue (tax keys 1237980 and 1237979).
Staff said the application requests a comprehensive plan amendment to change the future land use designation from Suburban Commercial to Urban Residential (comprehensive plan, chapter 10 land use and chapter 15 Neighborhood National Avenue East Corridor) and a rezoning from B-2 (General Retail Sales and Service District) to R-4.5 (a single-family residential district). Planning staff read the public notice and cited state statutory notice requirements during the presentation, noting the notice was published in the local paper on April 2, April 16 and April 23, 2025 to satisfy state statutes referenced in the notice.
Members of the public asked clarifying questions about what housing R-4.5 allows, whether both parcels could have residences, where access would be located, and the timing and noticing for a separate land division. Jim Abby, who said his property is at 3970 Towne Road, asked about parameters such as minimum square footage; staff replied the development would have to meet R-4.5 zoning requirements in the city zoning code. Staff confirmed access would be from Towne Road and that the applicant has a separate land division application to be reviewed after the rezoning and comprehensive plan actions; the land division would leave two parcels and could involve rotating a lot line.
Barbara Kepin (16230 West National) asked whether the land division would have additional public notice. Staff said the rezoning and comprehensive plan amendment would be taken up at the next meeting (June 2) and that the land division would be considered as part of that application; staff clarified the land division application does not require the same class of public hearing noticing, though neighbors could speak at the commission meeting under the public process. Staff directed residents to online materials and offered individual assistance.
No action was taken at the May 5 hearing; staff stated any formal action will occur at a future meeting after required notice and after the commission has had an opportunity to review related land division materials.
