Laramie County OKs outside-user sewer agreement for Archer Complex, agrees to higher rate

The Laramie County Board of Commissioners voted unanimously Feb. 18 to approve an outside-user sanitary sewer agreement allowing the Archer Complex to connect to the Cheyenne Board of Public Utilities wastewater treatment infrastructure.

The agreement requires Laramie County to pay 1.5 times the current sewer service rate for Archer Complex service. Ben Hornock, the county's owner representative on the project, told the board the agreement uses standard language from Cheyenne's outside-user contracts and that the Cheyenne board previously authorized staff to sign similar agreements. "This agreement includes standard language that's typical in their outside user agreements," Hornock said.

Commissioners discussed accounting for the project revenues. Commissioner Heath reminded the public the Archer project revenues are held in county reserves and must be tracked as such. "This is our 6P project that we have currently going on out at the Archer Complex," Heath said, noting the funds must be accounted for as part of county reserves.

If signed by the county, the agreement will return to the Cheyenne Board of Public Utilities for their signature before taking effect, Hornock said. The motion to approve was made on the record and the board adopted the agreement by roll call vote.

The county did not attach additional conditions to the agreement at the meeting. Staff said the agreement had been delayed several months after the Cheyenne board's initial action and was now ready for execution.

Ending: With the vote, county staff were authorized to finalize the agreement and proceed with the procedural steps required by Cheyenne's Board of Public Utilities for activation.
