Planning Commission recommends vacation of streets and alleys in town of Deeth to county commissioners

The Elko County Planning Commission voted to recommend approval of application ROWVAC25-001, a request from Raul Rodriguez to vacate all of E Street between Blocks B and C, the alley within Block C and a portion of the alley within Block B in the town of Deeth. Staff said the applicant owns the affected parcels and intends to combine them into a single parcel; staff supported the vacation with conditions.

Staff explained title to the vacated street and easement would revert to the applicant’s identified parcel (record owner listed in staff report) and that the applicant must comply with NRS 278.480 and any other applicable state statutes or local ordinances relating to abandonment of public right of way. Elko County noted it would reserve an easement for access and maintenance of public utilities if utilities exist within the right of way; staff reported there are currently no Elko County-owned utilities in those rights of way.

Commissioners asked staff about existing buildings that appear in GIS imagery within the right of way; staff said GIS suggests structures may be within the right of way but said a field survey would be needed to confirm. Bob Thibault of High Desert Engineering spoke on behalf of applicant Raul Rodriguez and offered to answer questions.

The commission approved a motion to forward the recommendation to the Elko County Board of Commissioners with staff conditions and findings. The motion passed on a voice vote recorded as "aye" with no opposition noted.

Ending: The matter will be forwarded to the Board of County Commissioners for final action per the county’s vacation/abandonment process.
