Planning board to remove sign-removal condition for Red Oak School approval after clarification

The Morris Township Planning Board clarified and adjusted a recent approval for a Red Oak School application after counsel said the wooden sign the board thought was temporary was in fact part of an approved landscape plan.
Ruben Perez of Fox Rothschild, speaking for Red Oak School Inc., asked the board "respectfully for an elimination of the condition that the wooden sign ... be removed," saying the sign is "a professionally made sign" and part of a zoning-permitted landscape package supplied to the board. Board counsel and staff confirmed the sign appears on the township zoning permit and that the earlier representations to the board had been made in error.
Board members said they had understood at the prior meeting that a wooden sign was temporary and would be removed; after hearing the zoning-permit evidence and an engineer confirmation that the sign appears on the landscape plan, several board members said they had no objection to removing the condition as a material requirement. The chair instructed staff to revise the prior approval accordingly and prepare a resolution memorializing that revised determination for the next meeting.
The board did not hold a new public hearing at the Jan. 13 meeting; counsel and school representatives made representations and the board decided how to proceed without entering a new, formal hearing. A resolution to reflect the change will be drafted and considered at the board's next meeting.
