Long Branch council adopts Third Avenue parking ban, tightens cabana rules; approves zoning-board appointments

Long Branch City Council on March 12 adopted two ordinances and approved multiple zoning-board appointments during a regularly scheduled meeting.
The council adopted Ordinance 03-25, prohibiting parking at all times on the west side of Third Avenue, and Ordinance 04-25, which amends the city code provisions governing seasonal storage lockers, bathhouses and cabanas by requiring seasonal renters to indemnify the city and by prohibiting subleasing. Both ordinances were at their second and final reading and were adopted after council opened and closed public hearings with no members of the public speaking on either item.
Why it matters: The parking change will alter on-street parking on a residential/municipal thoroughfare; the beach-code amendments change conditions for seasonal renters and could affect cabana availability and liability for users and the city.
Ordinance 03-25 was introduced at the council’s Feb. 26 meeting and carried to second reading on March 12. The council opened a public hearing on the ordinance, heard no public comment, closed the hearing and then voted to adopt the ordinance and order required legal advertisement. The roll-call votes recorded were: Councilman Dangler — yes; Councilman Rassus — yes; Councilwoman Wittes — yes; Councilwoman Rivera — yes. Council member Dr. Voda was absent. The motion passed.
Ordinance 04-25 amends Chapter 116 (beach-related code) by adding requirements for seasonal renters of storage lockers, bathhouses and cabanas to indemnify and hold the city harmless for claims arising from use or occupancy, and by prohibiting the subleasing of cabanas. That ordinance was likewise opened for public hearing with no speakers, closed, and adopted on second and final reading with the same recorded votes (Dangler yes; Rassus yes; Wittes yes; Rivera yes; Dr. Voda absent). The council directed that the ordinance be advertised as required by law.
The council also approved a set of appointments to the Long Branch Zoning Board of Adjustment on the consent agenda. The clerk read the items added to the consent agenda as Resolution 46-25 (a resolution appointing members to the Long Branch Zoning Board of Adjustment), Resolution 47-25 (appointing Daryl Spites as alternate member No. 1), Resolution 48-25 (appointing Lillian Grauman as alternate member No. 2), Resolution 49-25 (appointing Safty Valdeviezo as alternate member No. 3) and Resolution 50-25 (appointing Francisco Bronco as alternate member No. 1). The consent agenda was approved and the resolutions were adopted on a subsequent roll-call with these recorded votes: Councilman Dangler — no; Councilman Rassus — yes; Councilwoman Wittes — yes; Councilwoman Rivera — abstain. Dr. Voda was absent. The motion passed.
