Pensacola magistrate orders $25-per-day fines to start for 4120 Lenore Drive property

Special Magistrate Matthew Hargraves ordered daily fines of $25 beginning April 1, 2025, against the owners of the property listed in the case record as 4120 Lenore Drive after a city code officer reported the same violations remained unresolved from a March 18 order.

The order arises from Case No. 24-7782. Officer Kevin Smith, a code enforcement officer for the City of Pensacola, testified that the March 18 hearing had found the property in violation of the International Property Maintenance Code section 302.8 (motor vehicles) and municipal ordinance 14-4-3 (nuisance) for an inoperable utility trailer without a license plate and for a freezer door and car batteries being stored openly. "I inspected the property today, and the utility trailer remains inoperable due to not having a license plate affixed to it, and a freezer door and car batteries are still being stored openly on the side of the house," Smith said.

The March 18 order gave the owner a deadline to correct the violations by March 30; the order stated that a daily fine of $25 would commence on April 1 if compliance was not achieved. Hargraves said the city provided the required notices and, based on the inspection testimony, "I find that the property is currently in violation of the previously entered order of 03/18/2025. . . . I will order today that fines commence in the amount of $25 per day starting today, 04/01/2025." The case record lists the property owners as Nguyen Tan Thai Bin and No T Twee Fawn; the record indicates one respondent was present and did not establish compliance.

The magistrate noted attempts at contact had been made at the front door at the prior hearing and that the earlier order and notices were properly provided. The hearing record does not show further directives or an appeal outcome in the transcript.

The code enforcement authority adjourned after completing the day's docket.
