The planning board approved a settlement and conditional‑use approval for Maurici (Marisi) Real Estate Management LLC’s property at 833 Clifton Avenue, resolving an outstanding appeal and imposing operational limits.
Attorney Glenn Peterson presented the proposed settlement, and applicant Drew Maurici agreed on the record that all prior stipulations and conditions placed on the application would remain in effect and that the parties agreed to revised hours of operation. Under the settlement the applicant will operate from 7 a.m. to 7 p.m. on weekdays and from 9 a.m. to 7 p.m. on Saturdays and Sundays. The board also reiterated a prior stipulation that ventilation fans not operate while service doors are open.
A member of the public, Anne Bain of Cloverdale Road, spoke in opposition, urging the board to reject commercial intensification at the site and describing traffic and neighborhood impacts from repeated proposals for the lot.
Board members debated procedural history and the court’s prior orders. The motion to approve the settlement and grant conditional use, with the new hours and with all prior stipulations incorporated, passed on roll call. Commissioner Cabanix recorded an abstention; Commissioners Littaro, Welch, Vice Chair Withers and Chairman Kolodziej recorded affirmative votes. City Manager Villano and Mayor Grabowski also recorded affirmative votes but expressed reservations on the record about neighborhood impacts.
The board asked counsel to prepare a written resolution reflecting the settlement terms and the incorporated stipulations; staff will place the resolution on the record at the next meeting.
