House committee approves bill shifting lease tax responsibility to lessee, caps local tax on leases

Representative Jeff Wardlaw, R-94, told the House Revenue & Taxation Committee that House Bill 1960 would shift the tax responsibility on vehicle leases from manufacturers to the individual lessee and cap local sales taxes on lease streams at $2,500, bringing lease taxation closer to vehicle-purchase treatment.
The bill’s sponsor said the change does not alter the state sales tax rate but changes who remits the tax. "You're just moving the responsibility of the taxes to the individual," Wardlaw said, adding that lessees could "save about 75 to a hundred bucks a month" on lease payments.
Paul Gehring of the Arkansas Department of Finance and Administration (DFA) told the committee the department's reading is that the 6.5% state sales tax rate "should not at all be affected by this bill." Gehring said the $2,500 cap described in the bill would only affect local sales taxes collected on the lease stream, not the state portion.
Committee members had no additional questions. There were no witnesses signed to testify for or against the bill. Representative Wardlaw closed and asked for a favorable vote. The committee moved to a voice vote on a motion to pass; the chair announced the bill passed.
