The Planning Board approved a combined replat (SD005‑25) and vacation (VA002‑25) Wednesday that reconfigures parent tracts along the Richardson Highway frontage after state DOT highway improvements created new frontage road access.
Staff explained that a 40‑foot‑wide unnamed stub right‑of‑way had been dedicated on a 2013 plat to provide frontage prior to the 2020 DOT project. The 2020 highway improvements and the new frontage road made the stub right‑of‑way obsolete, staff said, and the vacation request would remove that dedicated stub so the replat can create a compliant flag‑stem lot (Track C) and adjust acreage that had been affected by DOT’s right‑of‑way take.
Planner George Stephan recommended vacation, citing historical platting and the change in roadway configuration. Applicant representative Jeremy Starks said the existing driveway and frontage better serve the home and that the previously dedicated stub did not fit built improvements.
Because a Planning Board member had a disclosed DOT conflict and left the dais, the board heard the combined motion and approved the replat and vacation by 6‑0 (one member excused). The board’s written materials note that the assembly may veto a vacation decision within 30 days under FNSB code and that subdivision and vacation decisions are subject to appeal as provided by borough code.
