Board conditionally approves temporary extension of premises for Old County Inn patio in Pine

The Gila County Board of Supervisors pulled consent item 4A for separate consideration on Feb. 4 and voted to approve a recommendation to forward the applicant’s extension of premises patio permit to the Arizona Department of Liquor Licenses and Control.
County staff explained an interoffice memo showed a timing issue in which the Community Development director submitted a disapproval after the agenda had been published; that raised due-process concerns and prompted the item’s removal from the consent agenda. The county attorney’s office advised the board it could consider the record and any statements made at the meeting and then forward a recommendation to the state agency. The state will ultimately review the matter de novo.
Randy, the county Community Development director, told the board that three non-permitted sheds on the property — used for commercial purposes outside the proposed extension area — were in violation when he reviewed the site. The applicant has paid fees, submitted required permit applications and scheduled a meeting with Public Health; Randy said the applicant was actively working toward compliance.
Board members and staff clarified that the extension area covered by the patio permit and the fencing is in compliance, and the outstanding violations lie outside that area. Supervisors discussed the possibility of approving the extension conditionally on the applicant coming into compliance; staff said they could forward supplemental materials to the state along with the board’s recommendation.
Given the applicant’s immediate plans and the pending fundraiser in March, supervisors expressed support for forwarding a positive recommendation while the applicant continues to address code violations. The board voted to approve the extension for the period March 14, 2025 through Sept. 7, 2025 and to forward its recommendation to the Arizona Department of Liquor Licenses and Control.
