Stark County Planning and Zoning Commission opened a public hearing March 27 to consider revoking conditional use permit CUP 01‑22, which allows a banquet/reception hall on roughly 39.96 acres at the property legally described in the southwest quarter of Section 4, Township 140 North, Range 97 West (address given as 1177130 First Street SW). The commission tabled the revocation to May 29 to give the applicant time to complete outstanding items required for a certificate of occupancy.
Applicant Brandy Johnson told the commission the property was rezoned and granted the CUP in 2022 and that the original plan included applying for a liquor license. After an inspection by the fire marshal, Johnson said a sprinkler system was estimated at about $50,000 and the applicants abandoned plans for an on‑site liquor license, instead intending to use outdoor event space and the lower level of the barn; the upper level would be storage only, she said.
Johnson said she hired GT Architecture (represented in the transcript by “Jared Too Good”), which performed a code analysis and supplied a revised code review and floor/furniture layout; Johnson said she received the code‑analysis documents on Feb. 4. She also said she had submitted a building permit and finally reached the fire marshal, who is scheduled to inspect the property on April 9.
Blaine Ducart of the building department (representing the City of Dickinson building department and Stark County) told the commission the outstanding item preventing plan review completion and issuance of a certificate of occupancy (CO) is a structural engineer’s review because the change of use from an agricultural building to an assembly occupancy requires an engineer’s structural assessment. Ducart said the fire marshal’s findings and the structural review could identify required corrections; only after the county has plan review materials and issues a permit can inspections be scheduled and a CO issued.
Commission discussion focused on whether the pending structural review and April 9 fire marshal visit could reasonably be completed within 30–60 days. The applicant and Ducart indicated they expected the fire marshal visit and that the structural engineer would discuss approach with the applicant’s consultant; the commission agreed to table the revocation to the May 29 meeting so the applicant can pursue the outstanding engineering and fire‑safety items. The chair clarified that if the CO is issued before May 29 there will be no further action; if the CO is not issued, the revocation request will return for possible action.
Action: A motion to table consideration of revocation of CUP 01‑22 to the May 29 Planning and Zoning Commission meeting passed on a roll‑call vote (all aye).
